TERMS OF USE

These Terms of Use (“Terms”) govern your access to and use of Yeswegays.com and all related features and services made available through Yeswegays.com (collectively, the “Service”).

By accessing, browsing, registering for, uploading content to, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and by the Privacy Policy, DMCA Policy, 18 U.S.C. §§ 2257/2257A Compliance Statement, and any other policies referenced herein.

If you do not agree to these Terms, you must not access or use the Service.

1. ADULTS ONLY

The Service is intended exclusively for adults.

You may access or use the Service only if you are at least 18 years old and have reached the age of legal majority required to access sexually explicit adult material in the jurisdiction from which you access the Service, whichever age is higher.

Minors are strictly prohibited from accessing, registering for, or using the Service.

By accessing or using the Service, you represent and warrant that you satisfy these age requirements and that your access to adult material is lawful in your jurisdiction.

You are solely responsible for determining whether accessing or using the Service is lawful where you are located.

The Service may use age-gate notices, account registration, and other access controls. Those measures do not replace your obligation to confirm that you are legally permitted to access adult material.

2. USER-GENERATED CONTENT PLATFORM

Yeswegays.com is a user-generated content (“UGC”) video-sharing and hosting platform.

Visual content appearing on the Service is submitted and uploaded by independent third-party users (“Submitters” or “Users”).

Yeswegays.com does not itself create, commission, film, photograph, or participate in the original production of User Submissions.

Submitters are solely responsible for the content they submit and for ensuring that their submissions comply with these Terms and all applicable laws.

The appearance of User Submissions on the Service does not constitute endorsement, approval, verification, sponsorship, or adoption of such content by Yeswegays.com.

The Service may also contain advertisements, links, integrations, embedded services, or other material supplied or operated by third parties.

3. USER ACCOUNTS

Certain features may require registration.

You agree to provide information that is accurate and reasonably current and to maintain the confidentiality of your account credentials.

You are responsible for activity conducted through your account to the extent permitted by applicable law.

You may not permit a minor to use your account or use another person's account without authorization.

We may suspend, restrict, disable, or terminate an account where we reasonably believe that these Terms have been violated, the account creates legal, security, or operational risk, or such action is otherwise appropriate or required by law.

4. USER RESPONSIBILITY

You are solely responsible for your use of the Service and for all content, information, files, images, videos, metadata, communications, or other materials you submit, upload, transmit, or otherwise make available through the Service (“User Submissions”).

You agree not to use the Service for unlawful purposes or in any manner that violates these Terms, applicable law, or the rights of another person.

You are responsible for obtaining all rights, licenses, permissions, releases, and consents necessary for your User Submissions.

5. UPLOADER REPRESENTATIONS AND WARRANTIES

Each time you submit or upload a User Submission, you represent and warrant that:

1. You are at least 18 years old and otherwise legally competent to submit the content.
2. You own the User Submission or possess all rights, licenses, permissions, releases, and legal authority necessary to upload, host, display, distribute, and otherwise make the User Submission available as contemplated by the Service.
3. Every person depicted in sexually explicit content was at least 18 years old at the time the content was originally created and had reached any higher applicable age of legal majority required by law.
4. No person depicted is a minor, and no person depicted appears to be a minor.
5. You have taken reasonable steps to verify the identity and age of every person depicted where legally required.
6. Every person depicted participated voluntarily and consented to the creation of the content.
7. You possess all legally required permissions, releases, and consents necessary for the lawful distribution and publication of the content.
8. The User Submission does not contain child sexual abuse material (“CSAM”) or otherwise depict a minor in sexually explicit conduct.
9. The User Submission does not depict or promote sexual assault, rape, trafficking, sexual exploitation, non-consensual sexual activity, or sexually explicit material distributed without legally required consent.
10. The User Submission was not created or obtained through unlawful surveillance, hidden-camera recording, coercion, force, fraud, or other unlawful means.
11. The User Submission does not infringe any copyright, trademark, privacy, publicity, contractual, intellectual-property, or other right of any person or entity.
12. The creation, possession, upload, publication, and distribution of the User Submission are lawful.
13. Where 18 U.S.C. §§ 2257 or 2257A, 28 C.F.R. Part 75, or other record-keeping requirements apply, all records required by applicable law are maintained by the person or entity legally responsible for maintaining them.
14. You will reasonably cooperate with legitimate compliance inquiries concerning content you submitted, including by providing information reasonably necessary to identify the original producer, rights holder, performer, or legally responsible records custodian where required by applicable law.

These representations and warranties are continuing representations and apply to every User Submission you make available through the Service.

6. STRICTLY PROHIBITED CONTENT

You must not upload, submit, publish, transmit, solicit, distribute, promote, or otherwise make available content that:

• contains or constitutes CSAM;
• depicts a person under 18 in sexually explicit conduct;
• depicts actual sexual activity involving a person who was under 18 when the content was created;
• depicts a person who appears to be under 18 in a sexually explicit context;
• uses titles, tags, descriptions, thumbnails, or metadata that suggest involvement of a minor;
• depicts sexual assault, rape, trafficking, exploitation, or other non-consensual sexual activity;
• constitutes non-consensual intimate imagery or was distributed without legally required consent;
• was obtained through unlawful hidden-camera recording or other unlawful surveillance;
• depicts or promotes unlawful violence, torture, snuff, or other illegal activity;
• violates applicable law;
• infringes intellectual-property, privacy, publicity, or other legal rights;
• contains malware or malicious computer code;
• impersonates another person for unlawful or deceptive purposes;
• contains materially fraudulent information in connection with an upload or compliance inquiry; or
• otherwise exposes the Service or another person to material legal or security risk.

Yeswegays.com maintains zero tolerance for CSAM, sexual exploitation of minors, content depicting or suggesting minors, and non-consensual sexually explicit material.

7. OWNERSHIP OF USER SUBMISSIONS

As between you and Yeswegays.com, you retain whatever ownership rights you lawfully possess in your User Submissions. Yeswegays.com does not acquire ownership of your User Submissions merely because you upload them.

By submitting content, you grant Yeswegays.com a non-exclusive, worldwide, royalty-free license to host, store, transmit, reproduce, display, make technically necessary copies of, format, encode, transcode, resize, generate thumbnails or previews from, and otherwise technically process the User Submission solely to the extent reasonably necessary to operate, deliver, secure, maintain, moderate, and display the Service and to make the User Submission available through functionality you elect to use.

This license also permits reasonable technical modifications required for compatibility, streaming, bandwidth optimization, content delivery, security, moderation, and similar operational purposes.

This license does not authorize sale of your User Submission as a standalone product and does not transfer ownership of your User Submission to Yeswegays.com.

Limited excerpts, thumbnails, titles, or previews may appear within the Service itself in connection with displaying, organizing, or recommending content already available on the Service.

You represent and warrant that you have sufficient rights to grant this license.

Following removal of a User Submission, copies may remain temporarily in backups, caches, logs, compliance systems, or other technical systems, and information may be retained where reasonably necessary or permitted for legal compliance, security, fraud prevention, investigation, dispute resolution, enforcement, evidence preservation, or legal claims.

8. CONTENT MODERATION AND NO GENERAL DUTY TO MONITOR

Yeswegays.com may, but except where required by applicable law is not obligated to, review, screen, investigate, moderate, restrict, disable access to, or remove User Submissions.

Yeswegays.com may use manual, automated, or third-party tools for moderation, security, compliance, fraud prevention, or other operational purposes.

The exercise of moderation or enforcement in one instance does not create a general obligation to monitor all User Submissions or guarantee that prohibited content will be identified, prevented, or removed before it becomes available.

Users remain solely responsible for their User Submissions.

To the maximum extent permitted by applicable law, Yeswegays.com does not assume responsibility merely because it receives, hosts, transmits, stores, formats, moderates, restricts, or removes User Submissions.

Nothing in these Terms limits any obligation imposed on Yeswegays.com by applicable law.

9. REMOVAL OF CONTENT

Yeswegays.com reserves the right, subject to applicable law, to refuse, restrict, disable, remove, or delete any User Submission where Yeswegays.com reasonably determines that such action is appropriate, including where content:

• violates these Terms;
• may violate applicable law;
• may infringe another person's rights;
• presents security or compliance concerns;
• is subject to a facially valid legal or regulatory request;
• may expose Yeswegays.com, its users, service providers, or others to material legal risk; or
• is otherwise inappropriate for the Service.

Where permitted by law, Yeswegays.com may take such action with or without prior notice.

Removal, moderation, investigation, or restriction of content does not constitute an admission that Yeswegays.com was responsible for that content.

10. REPORTING ILLEGAL OR PROHIBITED CONTENT

If you reasonably believe that content on the Service violates these Terms or applicable law, report it using the report function available on the relevant page or by contacting the Service through the contact mechanisms provided on Yeswegays.com.

Reports involving suspected CSAM, minors, sexual exploitation, trafficking, or non-consensual sexually explicit material may receive priority review.

We may preserve relevant information and cooperate with competent authorities where required or permitted by applicable law.

Copyright complaints should be submitted through the procedure described in our DMCA Policy. Knowingly submitting false, fraudulent, abusive, or materially misleading reports may itself violate these Terms.

11. COPYRIGHT AND INTELLECTUAL PROPERTY

You may not upload content unless you own it or otherwise possess sufficient legal authority to make it available through the Service.

Yeswegays.com respects intellectual-property rights and may remove or restrict access to material in response to a valid infringement notification.

Users who repeatedly infringe intellectual-property rights may have their accounts terminated in appropriate circumstances.

Nothing in these Terms limits any rights, defenses, safe harbors, immunities, or procedures that may be available to Yeswegays.com under applicable law.

12. Yeswegays.com MATERIALS

Except for User Submissions and third-party material, the software, design, graphics, logos, interfaces, text, compilation, and other proprietary elements of the Service may be owned by or licensed to Yeswegays.com and may be protected by intellectual-property laws.

No right, title, or interest in such materials is transferred to you except for the limited right to use the Service in accordance with these Terms.

You may not circumvent technological measures, interfere with the Service, scrape or collect information through unauthorized automated means, introduce malicious code, or otherwise interfere with the normal operation or security of the Service.

13. THIRD-PARTY SERVICES, LINKS, AND ADVERTISING

The Service may display or provide access to advertisements, links, embedded content, products, services, or websites operated by independent third parties.

Yeswegays.com does not control and is not responsible for the availability, content, representations, privacy practices, security, products, services, or conduct of independent third parties.

Your interactions or transactions with third parties are between you and those third parties.

To the maximum extent permitted by applicable law, Yeswegays.com is not responsible for loss or damage arising from your dealings with independent third parties.

14. SERVICE AVAILABILITY

Yeswegays.com may modify, suspend, discontinue, restrict, or change any part of the Service at any time, subject to applicable law.

We do not guarantee that the Service, any account, any feature, or any particular User Submission will remain continuously available.

Technical interruptions, maintenance, security events, third-party failures, or other circumstances may affect availability.

15. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Yeswegays.COM DISCLAIMS WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND RELIABILITY.

Yeswegays.COM DOES NOT WARRANT THAT:

• THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE;
• USER SUBMISSIONS WILL BE ACCURATE, LAWFUL, AUTHENTIC, SAFE, OR NON-INFRINGING;
• EVERY USER OR SUBMITTER WILL COMPLY WITH THESE TERMS;
• EVERY PROHIBITED USER SUBMISSION WILL BE IDENTIFIED OR REMOVED BEFORE BEING VIEWED; OR
• THIRD-PARTY SERVICES OR ADVERTISEMENTS WILL BE ACCURATE, SAFE, OR AVAILABLE.

YOUR USE OF THE SERVICE AND YOUR RELIANCE ON USER SUBMISSIONS ARE AT YOUR OWN RISK, SUBJECT TO RIGHTS THAT CANNOT LAWFULLY BE WAIVED.

16. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Yeswegays.COM AND ITS OWNERS, OPERATORS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THIS LIMITATION APPLIES TO CLAIMS ARISING FROM OR RELATING TO:

• USER SUBMISSIONS;
• CONDUCT OF USERS OR THIRD PARTIES;
• CONTENT THAT IS ILLEGAL, INFRINGING, OFFENSIVE, INACCURATE, OR OTHERWISE OBJECTIONABLE;
• ACCESS TO OR USE OF THE SERVICE;
• INABILITY TO ACCESS OR USE THE SERVICE;
• INTERRUPTION, SUSPENSION, MODIFICATION, OR TERMINATION OF THE SERVICE;
• UNAUTHORIZED ACCESS TO DATA;
• MALWARE OR OTHER HARMFUL COMPONENTS TRANSMITTED BY THIRD PARTIES;
• THIRD-PARTY WEBSITES, ADVERTISEMENTS, PRODUCTS, OR SERVICES; OR
• LOSS OR DELETION OF CONTENT OR DATA.

THE SERVICE IS PROVIDED TO USERS FREE OF CHARGE. TO THE EXTENT ANY LIABILITY CANNOT LAWFULLY BE EXCLUDED, THE TOTAL AGGREGATE LIABILITY OF Yeswegays.COM AND THE PARTIES IDENTIFIED ABOVE ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL BE LIMITED TO THE MINIMUM AMOUNT, IF ANY, REQUIRED BY APPLICABLE LAW.

FOR THE AVOIDANCE OF DOUBT, NOTHING IN THIS SECTION CREATES, ACKNOWLEDGES, ADMITS, OR EXPANDS ANY LIABILITY, RIGHT TO COMPENSATION, OR REMEDY THAT WOULD NOT OTHERWISE EXIST UNDER APPLICABLE LAW.

ANY LIMITATION UNDER THIS SECTION APPLIES IN THE AGGREGATE PER CLAIMANT, REGARDLESS OF THE NUMBER OF ACCOUNTS, USERNAMES, CLAIMS, CAUSES OF ACTION, TRANSACTIONS, EVENTS, OR INCIDENTS INVOLVED.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY TO THE EXTENT SUCH LIABILITY CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

17. INDEMNIFICATION

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Yeswegays.com and its owners, operators, affiliates, licensors, service providers, officers, directors, employees, representatives, and agents from and against claims, demands, actions, proceedings, liabilities, damages, judgments, settlements, penalties, fines, losses, costs, and expenses, including reasonable legal fees, arising out of or relating to:

• your access to or use of the Service;
• your User Submissions;
• your violation of these Terms;
• your violation of applicable law;
• your infringement or alleged infringement of copyright, trademark, privacy, publicity, contractual, intellectual-property, or other rights;
• any allegation that you lacked the rights or authority necessary to upload or distribute a User Submission;
• any allegation concerning the age, apparent age, identity, consent, exploitation, or rights of a person depicted in your User Submission;
• your failure to maintain records required by applicable law;
• any false or misleading representation made by you concerning a User Submission;
• any unlawful conduct undertaken through your account; or
• any claim by a third party arising from content you submitted.

Yeswegays.com reserves the right, where permitted by applicable law, to assume control of the defense of a matter subject to indemnification. You agree to reasonably cooperate with such defense.

These obligations survive removal of content, termination of your account, and termination of these Terms.

18. ACCOUNT SUSPENSION AND TERMINATION

Yeswegays.com may suspend, restrict, or terminate access to the Service where permitted by applicable law, including for:

• violation of these Terms;
• repeated copyright infringement;
• submission of prohibited or illegal content;
• suspected fraud or abuse;
• security concerns;
• failure to cooperate with legitimate compliance inquiries; or
• conduct that may expose Yeswegays.com or others to material legal or operational risk.

Termination does not affect provisions that by their nature should survive, including provisions concerning ownership, licenses necessary for retained records, disclaimers, limitation of liability, indemnification, dispute resolution, and legal compliance.

19. PRIVACY

Our collection and processing of personal information are addressed in our Privacy Policy.

By using the Service, you acknowledge that information may be processed as described in the Privacy Policy and as otherwise permitted or required by applicable law.

20. LEGAL PROCESS AND COOPERATION

Yeswegays.com may preserve or disclose information where reasonably believed necessary to comply with applicable law, valid legal process, court orders, governmental or law-enforcement requests, enforce these Terms, investigate suspected illegal activity, protect legal rights or safety, or establish, exercise, or defend legal claims.

Nothing in these Terms requires Yeswegays.com to disclose information in response to an informal or legally invalid request.

21. CHANGES TO THESE TERMS

Yeswegays.com may modify these Terms from time to time.

Updated Terms will be made available through the Service with a revised “Last Updated” date.

Where required by applicable law, additional notice or consent may be provided or obtained.

Your continued use of the Service following the effective date of revised Terms constitutes acceptance of those Terms to the extent permitted by applicable law.

22. ASSIGNMENT

You may not assign or transfer these Terms or rights granted to you under these Terms without prior authorization from Yeswegays.com.

Yeswegays.com may assign or transfer its rights and obligations under these Terms in connection with a reorganization, transaction, transfer of the Service, change of control, or otherwise where permitted by applicable law.

23. SEVERABILITY AND NO WAIVER

If any provision of these Terms is determined by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permissible or severed to the minimum extent necessary, and the remaining provisions shall remain in effect.

Failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.

24. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, DMCA Policy, 2257/2257A Compliance Statement, and any additional policies or terms expressly incorporated by reference, constitute the agreement between you and Yeswegays.com concerning your use of the Service, except to the extent otherwise required by applicable law.

25. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of Cyprus, without regard to conflict-of-law principles, except to the extent mandatory law provides otherwise.

Subject to any mandatory rights or jurisdiction that cannot lawfully be waived, the courts located in Limassol, Cyprus shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service.

You consent to the jurisdiction and venue of those courts to the extent permitted by applicable law.
